All of this sounds like a bunch of crap... how the hell could someone be killed because they couldn't get the car out of 5th? Kept accelerating? That's what the clutch is for... Possibly got stuck in traffic, stopped, in 5th, and couldn't get the car going again? I am suspicious. The transmission in the 900 has been the same for the last five years, so I seriously doubt a problem just popped up. Let them replace the tranny under warranty (that's what a warranty is for) and see what happens. Don't go off the deep end because you may have an issue with the car. If the dealer is willing to work with you on the problem, let them help. No car is perfect - every factory pops out an off one now and then, which isn't an excuse, I suppose, but more like an explanation. -Justin
