Again, if this matter is resolved, I would welcome the opportunity to rescind my earlier statements. I do not have a clue why you have not received my messages. The following is the text of the last message I finally felt necessary to send to - it is dated November 18, 1998 - - - To: Dahoud Andre 105-21 79th Street Ozone Park, NY 11416 This is a FINAL NOTICE ! As you well know, you are delinquent in paying for the Saab 9000T Shop Manuals that... a) you purchased from me, and b) which were shipped to via UPS-COD, and c) which were accepted by you, and d) paid for by you via a personal check that "bounced" due to "insufficient funds" when I deposited it. Subsequently I notified you via e-mail on several occasions (specifically 11/1, 11/3, 11/5, 11/7, 11/10, and 11/17) requesting payment via Money Order. In fact, on 11/3 you acknowledged receiving notice of the bad check from your bank! [NOTE: As you can see, I tried repeatedly to contact you!] You must forward payment in the form of a Money Order in the amount of $140.14 (derived from $100 agreed price for the manuals, plus $15.14 for UPS charges, and plus $25 for the bounced-check charge from my bank, all of which you previously agreed to pay) to be received by me no later than Monday, November 23, 1998. Failure to do so will result in my taking the following action: On Tuesday morning, 11/24/98, I will advise my Collection Agency (Williams Alexander & Associates, of Wayne, NJ, to whom I have already forwarded all records pertaining to this matter) to proceed with the legal course that they have proposed to me - namely, Williams & Associates will instruct their staff Attorneys to file a criminal complaint with the Queens County Court against you, citing violation of New York Penal Code # 190.05, et al. It is with very deep regret that I find it necessary to take this extreme action. I had sincerely hoped that I was dealing with an honorable person, and I sincerely hope - even at this late date - that you will act honorably and forward payment as requested above. Frankly, I still find it hard to believe that you would stiff me for a mere $140 - it's such a small amount for you to steal and risk not only jeopardizing your own personal reputation and honor, but also risk indictment and conviction in a criminal case. However your repeated failure to fulfill your commitment in this matter has left me with no other alternative. Dahoud, please understand that this is no idle bluff. I am originally from the NY metro area, and I still have many contacts there. You may note from the "CC" address to this e-mail that my son is a principal claims investigator and collection agent for Williams Alexander & Associates, and - as noted - their Attorneys are staff members on fixed retainer. Accordingly there are no additional fees involved for taking the above action. In conclusion, I urge you in the strongest possible terms to "do the right thing". Henry G. Grilk 411 Mt. I would be very happy to issue a "broadcast" mailing rescinding my accusations if, in fact, you promptly forward payment. Believe me, nothing would make me happier to realize that I am really dealing with an honorable person. I only wish I had heard from you earlier. Regrettably, however, I have already started the action referenced above via my Collection Agency (Williams Alexander & Associates, of Wayne, NJ) and they have already begun processing the legal "alternative" noted. In view of your e-mail, I will advise them (by way of copy of this e-mail) to "HOLD" pending further notification from me. I will further contact them by phone the first thing tomorrow morning. In addition, since this matter has already been turned over to Williams Alexander & Associates, I believe that it will now be necessary for you to deal with them.
