At least, that's what it's supposed to be. For some reason, I thought the OP was in the UK, but I wasn't paying that close of attention (obviously). For what it's worth, in a civil court it's "by a preponderance of evidence", which is why OJ was found "not guilty" in the criminal court, but was found liable for killing them in the civil court.
