Both are great cars, slightly different. 2007 is a good MY for Spec-B, with early problems worked out. 2010 is also a good MY for the 3-series. Sport package is a must for the 3-series, but the seats are likely to disappoint compared to the Viggen. It all comes down to personal preference. 328i is "premium" so will be less annoying. Spec-B is an economy car with $15k worth of upgrades, but oh so good dynamically. Personally, after years of driving AWD Subarus, I just prefer RWD if you are into performance driving at all. 328i is set up very soft compared to inverted Bilsteins on Spec-B. Throw some Bilstein coil-overs on the 328i and you will ruin the ride balance to make it much closer to Spec-B.
If the 328i is still under warranty, consider buying an extended warranty. I bought a BMW extended warranty for my 550i, getting a great price by shopping around. Ended up buying from Passport BMW for $20 above dealer cost.
