In Indiana, I don't believe that you can simply confiscate game normally subject to a hunting license.
Last January I killed a deer with my 2002 Aero SW.
A minute or two later, a pair of deer hunters drove up, admiring my hunting prowess. Only took another minute or so, and an off-duty copy stopped. A on-duty copy showed up shortly.
My understanding, they could have waited until a conservation officer wrote it up, then taken the deer. I had had first dibs, but declined.
There was only a day or so left in the hunting license period, they had an unfilled license, so they could take the deer w/o waiting, and apply their deer hunting license as needed. At least I think that's the rules, the officer seemed a little vague.
