I'm pretty sure that you will be able to find a rear axle assembly if you are inclined to go that route - cars usually get totaled by hits in the front. Don't try to bend what you have, I doubt that it will work. Should also be able to find an Aero wheel somewhere like car-part.com. So the question is how bad is the rear fender?
Twenty years ago, I won a case in small claims court. The next stage is trying to collect, which is another can of worms. I had to file a wage garnishment, which the employer ignored, so I eventually collected from them. A lot of work, but justice prevailed.
