They can't anyway. If it was malfunctioning repeatedly before your warranty was expired, they still need to cover it after. This was the case with our water pump which at about 45K started making some occassional awful noises and was noted when we brought the car in for warranty work. Since it was in our file at 45K, when it died at 60K, 10K out of warranty, it was still replaced under warranty.
