The dog owner is responsible and I would hope you pursue the claim even though the dog owner likely sees it differently . My experience has been that people make all sorts of excuses for not controlling their dogs, but whenever I've contacted local authorities they are clear in stating that the dog's owner is responsible for obeying leash laws and having the animal under control at all times.
