Times are tough for any sort of contractors right now, so they may have reviewed their "hopeless cases" file to find potential sources of income to tide them over - sounds like your case came up. However, the fact that they waited three years (the warranty period?) to come after you is BS and may be their standard operating procedure.
If the job is salvagable, you may be better off to evaluate what it will cost to fix what you have, then negotiate a settlement. Small claims court can take a lot of time and produce odd results, especially if they hire a lawyer and you don't - and they may have hired a lawyer to go after a bunch of "hopeless cases", lawyers are also hurting and hungry for work. Even if they don't show up in court, in Illinois they have 30 days to come back and challenge a judgment, which can start the process all over again.
