If you suspect I'm a bad driver, then you should be happy to know that cell phone use (and I use it extremely sparingly) has saved me (and bystanders) from unnecessary trips on numerous occasions.
Another point you missed is that I explicitly suggested heavy penalty, such as high fines and license suspension, for those causing accident while on the phone (i.e. proving themselves over-estimating themselves). The pre-crime approach taken by laws banning cellphone use is unwarranted.
If we are into regulating against pre-crimes, motorcycles should all be banned from highways . . . simply because they have much much higher accident rate per thousand mile driven than cars and SUV's. Motorcycles are simply incompatible with everything else traveling on public highways. Numerous innocent car drivers have been maimed due to the need to dodge thuggish motorcyclists. Their noise making is extremely distracting to themselves and other drivers sharing the road. (Tongue in cheek of course; motorcyclists should have the right to get themselves killed. Unless and until faced with physical violence and intimidation from thugs on bikes, other drivers can stuff it with their complaints about noise distraction.)
