That is well established in court precedences. You can not sue the government or its agents for failure to protect you. You are responsible for your own protection . . . the ultimate protection from traffic accident is staying off road! Using cellphones can help you stay off road sometimes; timely phone calls have helped me avoid many unnecessary trips.
The brain studies that you talk about still fail to address the very simple issue that I raised: while 1 minute of time when the phone is being used might be distracting for that 1 minute, the timely notification may well make the next 20 minutes of driving much calmer and focused (not having to rush after notifying waiting counter party); in many circumstances may even help avoid a separate trip that may take much more than 1 minute! So the net effect of judicious cell phone use can be positive for vehicle safety! and enhanced safety for 3rd parties sharing the road.
