Hello,
As someone that worked in the insurance claims department of a large insurer for several years, though not recently. It all comes down to who you are dealing with and whats going on there.
So first it comes down to if you are the insured or the claimant. It appears we are assuming that you are the claimant and this is not your insurance company. If this is the case you are completely in your rights to request that you are paid enough to replace your current car. So research equivalent cars to yours, trim, option, mileage etc... in a widening circle from your location. Stick to your guns and tell them that is what you need to replace the car their insured ruined. If they can get that amount authorized and they think they can get the claim handled by the end of the month they will do so. If not they will ignore you. So give them a number let them know if you get it you will sign off and get them closer to whatever there percentage of closed to new claims they need to be at.
If you are the insured on the other hand you are stuck with whatever your declaration sheet says. So if it says acv (actual cash value) you have little power to request more than what they want to give you. If you have a policy with a stated value then that's what you get.
