Just because a vehicle has a cup holder fitted it doesn't follow that it will be used while the vehicle is in motion? Many people pull up at beauty spots etc and have need of the facility then. I suppose you are going to tell me that it's a distraction to have my radio on, or to smoke, and that I should be prosecuted? Using a cellphone enages the *mind* - something you don't want when driving (I know - I also ride a Honda motorcycle and have to be constantly alert in place of the car drivers who seem to want to kill me).
