This was a reasonable lawsuit decided by a reasonable court. The damages were not unrealistic considering the scope of MacDonalds empire and the need for punitive damages. Also, it was noted in the summary that the woman tried to settle for her medical costs, $20k, and MacDonalds preferred to go to court over it. I imagine that the lawyers didn't want to settle one claim as they'd then be approached to settle the other 700 claims too. Bad choice on their part... but good job from the MacDOnalds marketing folks trying to get it permanently labeled as an example of bad tort law. Now I'm way off topic... so I'll digress. I once had an issue with a Toyota catching on fire. It was definitely a design issue in the heater box (details on request). It cost me about $300 to repair the damages. All I wanted Toyota to do was to pay for the cost of repairing the car. They refused, I worked up to the factory district rep level. After talking with him, he went to do some "research". I called him on the phone a few days letter and he said something like "Toyota does not feel that they are responsible...". I pointed out a couple of specific issues that he had failed to address. He said "Toyota does not feel that they are responsible..." and did a word for word repeat on his first statement. After the third go round on this, I finally realized that he was reading a statement prepared by their lawyers. Evidently they *did* realize I had raised a significant issue, had discussed it up the ladder and over to the legal department, and had realized how many millions of dollars it would cost to recall/fix all their cars with this design. Additionally, if the fire in a similar incident were to kill someone, they'd be responsible for millions in loss of life claims. The lawyers solution was to deny all responsibility - even though they could have shut me up for $300. I almost took it up with the NHTSA just to bust their chops for being such a bunch of boneheads, but I had other things to do, so I let it go. Bob
