However, the reason she won the case was that MacDonalds had been sued twice previously over the same matter. They were serving coffee at a temperature that was around 160 degrees IIRC. This is hot enough to scald. The previous two lawsuits had pointed this out to Macdonalds. MacDonalds has a tight rein on how each franchise operates. They have a book, which all franchises are *required* to follow, that specify's every little detail of operation. Among these was the company wide policy, which they failed to change, which specified that they serve coffee hotter than the "reasonable man" would assume.
