I lost on a ticket based upon laser/observation, and argued on appeal as to the observation that without a reference speed, one can not determine anything via observation, as pointed out by Einstein in a dissertation on relativity -- the appeals court didn't get into that, though, and based their affirmation on the laser (one judge did smile, and said it was the first time anyone had cited Einstein to her in a brief).
