I'm not sure I fully understand the system you're describing, but I think it works a little differently on the old 9-3.
On the old 9-3, when the headlights are on (whether DRLs or switched to "on" position), the auto-dimmer is enabled. The dimmer is disabled only when the DRLs are disabled and the headlights are switched "off". When that happens (ie, the headlights are off), the car assumes it's daytime and makes the instruments full brightness.
I like the auto-dimmer. Keeps glare down at night or in lower-light situations, but it makes the LCD really bright when it's in direct sunlight.
