shortening the pick up tube means that if for some reason your oil level is low, it'll suddenly be sucking air instead of oil -> zero oil pressure. If that happens whilst you're driving you can say hello to a ruined bottom end.
The sludge issue is not related to the cat converter or it's placement. The newer 9000 also had the cat right under the oil pan and there were never sludge problems with that model...
Besides - if the oil was being broken down by the heat from the cat, it wouldn't make a difference shortening the pick up tube. There would still be oil in the bottom of the oil pan being "fried". But again, that's not really an issue.
