If you tighten down the bolt and nut properly it is no way that it would be able to move. You would dent the rims in those potholes before that.
But of course it takes an alignment shop that employ technicians that have the capability to think and evaluate different scenarios for themself and tighten bolts to proper values, something that some low cost or big chain stores might not have.
Since it is a fair amount of alignment shops that say you cannot align the rear end of the 9-5, you now what you are dealing with.
