It's an awful situation to be in both for you and the shop and no real good answers to give.
Yes, you would think topping off transmission fluid would be part of the oil change and inspection of car but then again, they don't know if the owner use a special type of oil or not but at least notify and ask the driver/owner if there are no visible oil on the transmission dipstick, not just make a remark.
Since they did make a remark on the invoice your son got, I would want to give them the benefit of doubt and that they indeed checked the oil level. Otherwise,why would they dot down the remark at all.
I also know in what a hurry the car owners are when picking up the car and many only listen with half an ear to what I say since they want to get out and on the road as quick as possible.
Luckily if they call and ask about something and why I didn't check this or that, I have it in writing and that I indeed mentioned it to them.
Since it is as you say a reputable Saab indie you would think that they know the difference between the two drain plugs as long as it was not a newly hired tech doing the oil change which in that case would be quite likely to be the culprit.
And if the oil change had been done at a quick lube place, it would not be strange at all to have the transmission drained and engine over filled as a result.
Since this is a stickshift I don't know if it would make it several thousands of miles empty but the automatic will when the quick lube places drained the differential.
It would take about 3000 miles or so for the pinion bearings to seize making it just about impossible to win a claim against the lube shop due to the long time and mileage passed.
It also differs depending on what type of driving is done. If the car only see short trips of 10-15 miles or less between cool down, the bearings last a lot longer than if you would to take a 1000 mile trip in one sweep.
So unfortunately, it is not much that can be said to make the situation better for you.
I sure would hate if I had a brain freeze one day and did something like that.
