It's probably more problematic than old brake fluid. Usually the problem is the pump not running. If you are hearing the pump run, but the level isn't dropping, my guess is that one of the valves in the system is stuck open - the pump runs, but instead of pressurizing the system, just circulates it.
First test - start the car, and wait for the lights to go out, then wait a little more until the pump stops running. Now, repeatedly hit the brake pedal - firm, fast presses, until the ABS and Brake Fluid lights come on.
If it takes 12 or 14 firm (hard) fast presses of the pedal to get the lights on, then the accumulator is OK. If the lights come on after 3 or 4 presses, then the accumulator (the black sphere) has failed and needs replacement.
Doing a brake fluid flush is always a good idea. If there is some stuff stuck in a valve somewhere, this might help. I have seen problems with the lights coming on when the car gets hot, but that's usually due to the pump overheating and shutting itself down, and not running. Are you sure that the ABS pump was running?
