When my car was totalled, I negotiated the price THEN asked if I could buy the car from them - it may not have occurred to them that I would be interested in a smashed car for $238. Repairable or not, I figured that I could pull off $238 in parts in less than five minutes, i.e. DI Cassette, radio, CD changer, lights, Aero wheels, Aero ECU, etc.
Laws vary by state, but in Illinois you can't buy back a totalled car that is less than seven years old (insurance fraud prevention?). On the other hand, since the title was never transferred, the car does not get a "Salvage" title - which itself is ripe for fraud.
