Trans Fluid Change - How much does it really hold?

I have a 93 CSE with 113k. The filter on tran was changed 6 months ago. I
bought the 8mm hex key for the drain plug to do myself. When refilling I stopped at 5 qts to check and it shows overfilled on the cold measurement on right on max (80c) when checked after running. The manual says it should hold 8+ qts. How do you get all the fluid out?
When checking the stick isn't 40c the cold measurement and 80c hot?
Is it safe to leave as is or should I remove some fluid.
