Seat back pocket is torn

The passenger side seat back pocket on my '99 9-3 is torn slightly in a few places at the top. I don't know if this is a defect, has been caused by putting the rear seat down, or was caused by something else.
Before I ask the dealer about it, has anyone else experienced this problem?
Could you please take a minute to check and reply to me?
Naturally, I'd like to be in a position to persuade the dealer that this should be a warranty item. For the record, my dealer, Continental Motors in Oceanside, CA, has been very good about such things.
