Heres the situation.
My brother had a car w/$5000 loan balance. He has been travelling extensively (he's a performer & contractor) between several locations and out of the country.
He had been using our parents address (I think they cosigned loan, too), and he definately spent the summer at their house putting an addition and renovation on the house.
He was accepted at a University out of state for a higher degree program, and is enrolled there.
When out of the country, his car was stolen and stripped. Trunk lid, Stereo, dash, etc. Ins co impounded car to avoid racking up storage. The insurance company started with the premise that he was trying to defraud them on with the theft. (He wasn't)
It's been about a bit more than a month Now they have done an "investigation" and are denying the claim because of residency. They also alluded that he "could" be liable for the cost of the investigation, but it sounds like they just don't want to pay. What recourse does he have, and how can he follow up? He is leery of going the $$$ attorney route. I believe his residency claims are valid, although I don't believe he had any one address for more than 4 months at a time for the last several years, and he is a student. He'd clearly be able to show gas reciepts for all of his travelling to show that he is often on the road.
Is there a way to appeal to a insurance regulatory agency, or a better way to handle this? He is devastated, and a broke student. On top of this, the insurance can't be cancelled on the car w/o a release from the lender, which means he'll have to take a personal loan to pay off the car, which is junk.
