Amy,
Glad to hear you are OK. Sorry about the loss of your new Aero. I'm sure the insurance laws are different by state. But in Michigan, where it is a no-fault law, meaning my insurance covers only my car even it is at my fault. This is supposed to be done to reduce/eliminate law suits. In this case, if it is deemed as my fault, I pay the deductible. If it is not my fault, then I can sue the other driver for my deductible... Having said that, I was told that if I am about to hit a deer, and I swerve to avoid it and wreck my car, which is your situation, it is deemed my fault. I would pay my deductible. Insurance rate would go up. If, however, I hit the deer, I am not at fault. I may have to pay the deductible for comprehensive coverage. My insurance rate does not go up. Therefore, they say I am much better off hitting the deer than avoiding it. (sad to say). It may be different in Washington, but you may be faced with similar situation. I hope this helps. Good luck
James from Michigan...
