I think it comes down to this: is it to the letter of the law, or in the spirit of the law? An aside: That's also perhaps a good question to ask the officer. Where you exceeding the spirit of the law (safety) or the letter of the law (a numerical value). (Numbers are often used to demonstrate/quantify the spirit of the law)
I know in CA and WA, posted speed limit signs are not always enforceable to the letter. If the signs posted read "Speed Limit 35", Law Enforcement does not have grounds to cite me for 36, unless it is unsafe (that is, not reasonable or prudent). If the signs posted read "Maximum Speed 65", then 66mph is grounds for citation, no questions asked, except of course, the one that goes like: "Do you know why I stopped you?" wink wink Interesting. Just thought I'd share.
Note: the source of this distinction comes from a commissioned police officer (Formerly WA state, currently CA state). I could find the statute if anyone cares.
