1) you can't read the CDR (air bag module) in your wife's Mazda, or the one in the 2000 Durango because Vectronix software used by police and reconstructionists like me is not supported by Mazda or Dodge.
2) His story doesn't matter as much as you think - the evidence at the scene, if notes and sketches were made by police will trump the lack of eyewitnesses.
3) The amount and direction of crush to the Mazda, at its front left side says that the impact was offset, which is not typical of a rear-end collision for someone who is stopped in the middle of a lane. Thus there is a distinct possibility that he failed to stop and turned left from the gravel road to the east side, because the Mazda hit first there (largest crush). The damage pattern on the truck would tell the rest of the story.
4) Even if he was charged for failing to yield the right of way, what difference will it make - the other side will argue that the Mazda should have detected the hazard and taken evasive action to avoid a collision.
5) You are very lucky, but your wife is luckier - few people only have a swollen ankle after a 60 mph collision with another vehicle. Don't ask me how I know it was more than 40 mph, I just do.
6) Depending on the injuries to the other driver, you may be sued. Give your insurance company, who will be responsible for defending you in civil court, as much data, copies of your photos and other information as you can. They are not your friends, but better to have them paying the lawyers than those funds coming out of your own pocket. Insurance companies hire reconstructionists to evaluate the balance of probabilities, and since it is a "he said - she said", the recon's findings will make a big difference. I just hope she wasn't talking on a cell phone.
