Here's the story: we started a kitchen remodel and on 10/28 selected stone for counter tops at a nearby (70 miles) stone fabricator/installer; huge place with literally hundreds of different stones in stock. At that time, we placed a deposit to hold our stone and were lead to believe the installation would be complete within three weeks. Through a series of drafting errors and un-returned communications (email & phone), nothing but the drafting has yet been done and we have requested a refund of our deposit minus the actual costs they have accrued in traveling to our home, templating the kitchen, etc. We're happy to pay for the work they've done, but we're tired of dealing with them. They're saying they don't give refunds and have offered us a 10% discount and a promise of completion by Christmas. But, as I say, we're tired of dealing with them. We see no reason for them not refunding our deposit (the stone wasn't special order, it hasn't been cut, we're willing to pay for work completed, etc.) but still they say "no refund." They claim this is their policy, but I've signed no contracts and they have yet to produce anything with this policy written on it.
So what would you do? Write off the deposit and walk away, figuring freedom from them is worth the loss? Bargain for a bigger discount? Take them to court? Something else?
