one other minor point - once a product is out in the marketplace, it becomes prior art, so a 3rd party above couldn't easily patent eg x86 tech + successfully prevent intel (or AMD) from using it (though it would not surprise me if someone might try to get the patent + have it accepted by the office: it is amazing how much prior art gets through, it just doesn't hold water in court). I suspect the real reason was in case some element of a patent became more valuable down the road +/or circumstances changed wrt the agreement (which to some extent they have, moreso in the sense of subsequent technology than the x86 stuff per se)... clearly it was important to Intel that they stamp their name on the IP + for them it would probably be foolish not to (imho)...
btw, to a large extent, I do share your distaste for some elements of the system...
