As I read the original post, the guy in the Neon did not "pass", he moved into the oncoming lane, moved to a certain position, and stopped. That is not passing.
Also at least here in MA, you are required by law to stay 100' behind a school bus at all times. Not that many people pay attention to that, but any maneuver that put you less than 100' from the back of that bus would be illegal in that way also.
And yes I know that it's usually not possible to pass a school bus without getting less than 100' from the back of it... don't ya love when laws contradict each other?
