That is a very interesting question. I've wondered the same thing myself... having driven the NYS Thruway/Mass. Pike stretch quite a bit. I have no idea if any calculation is made from start to end time when you go through the Fast Lane/EZ Pass booths that could stand up in court against you but I would think you would have to be going REALLY fast to trigger something like that - otherwise it could be attributed to stops/no stops, meals/no meals, etc. If we're talking the difference between 65 and 80 or 85 I would think they wouldn't have much to stand on in that regard.
In asking a NYS Trooper friend of mine he indicated that in NY you need to be "seen" to be given a speeding ticket. Reading between the lines, I assume this is why they can mail you a ticket for speading through an EZPass lane when your "picture is taken" but I also drew the conclusion that since you were not witnessed doing 85 earlier in your trip to make good time, you would not be cited for that. I've had EZPass in NY/Mass. since they implemented it and have never had a problem with this.
Just my $.02 - but certainly not a reason or excuse to drive recklessly... not everyone on the road is a phenomenal driver (as typically found in a SAAB) and has such a fine automobile capable of such great things. :-)
