take pics anyway. Sounds as if there is enough circumstantial evidence that it would still fly. I'd approach your neighbor when your cars are parked, and ask him to come look at something. Show him the relation to the cars, the dent, the 'swapped paint'. Then politely ask him if he would like to handle this thru his insurance or out of his own pocket. If he squeaks and moans and starts getting defensive, then just wander on down to small claims court and file.
Bear in mind that you still have to live next to each other...sometimes people can get really weird and vindictive, so hopefully you know your neighbor a bit and settle it amicably. Just because you didn't take pics right when it happened doesn't mean it DIDN"T happen. Sounds pretty straightforward to reconstruct the incident.
