Generally, the person prosecuting speeders wants to a high conviction rate even if it means lowering what people are being convicted of. About 14 years ago, I had a lapse in concentration while driving at high speed (95 in a 55) and didn't notice a cop come up behind me at night (he got on an on ramp). I went to court and worked a quick deal with the prosecutor to plead guilty to 75 in 55. I didn't want to risk the cop showing up and a gauranteed conviction at the higher rate of speed. It worked out in the end - about $100 in speeding fines, a couple of points on my license for 18 months, and no increase in my car insurance, amazingly enough.
