I just got off the phone with the dealer and they said the engine needs replacement, cracked #4 piston, cylinder wall scoring. The Saab USA rep told them that the only way the damage could have occured is by "overboost" and that they will not cover the repair. They said they found differences in the ECU code that is not Saab code. This is with the STOCK ECU! or as far as I know it is.
I called Saab customer assistance, and they said whatever the Saab Rep said goes. But they will call me tomorrow with more information and a further explanation.
Not to be a Saab basher but from the information they have this seems like a hasty decision and quite a lack of support. How can they say that "overboost" caused the problem and that "some code doesn't appear to be Saab code". And if so (I am not the original owner of the car so it possible ecu work may have been done but very unlikely), can they prove that the damage was done by this apparent non-saab code which had a definite result of overboost which definitely caused piston failure?
I am far from being an atty, but this sounds like they would have difficulty proving the cause. I don't see any provisions in the Magnuson-Moss Warranty Act that actually describe what burden the business has to prove anything in order to deny warranty coverage although.
Anybody know how much a b235r goes for? :-)
