My 03 went back. Basically check the rules for your particular state and see if you meet the letter of the law. I gather they vary a LOT! I really don't think you need to talk to an atty ... at least here in Calif.
It's important to document when the problem was first reported and attempts to fix it/down time. In Calif there's a depreciation schedule for use from the time it was first reported. I think there's a special accelerated provision for safety related problems too. It'll all be on your State consumer affairs web site.
Once you put Saab on notice (Saab USA, not the dealer) then they will move heaven and earth do fix the problem. If they don't/can't then they just cut you a check and take it back or find you a replacement. Calif has an arbitration provision ... Saab don't want to go anywhere near that either. They wind up with a lemon law title if they go that route.
All in all I felt like I was treated fairly, though there was a bit of fun over when the problem was first reported.
The 05 I bought to replace it has been pretty good. The service light just came in at almost 15K and this will be it's first trip to the dealer since I picked it up! I chickened out and changed the oil at 10K .. was still on full though.
