Often manufacturers buy cars before they go lemon law and before the car winds up with a branded title "Lemon Law Buyback". So it could be both or either. They could be branded title lemon law buybacks or, in service techno speak, consumer satisfaction buybacks which aren't offically lemons, but were going in that direction before Saab agreed to take the car back before it becomes an offical lemon.
At the right price both should be considered.
IMO there are many more lemon owners than true lemon cars. That is, once a car has pissed you off, you can turn it into a lemon, by being hyper sensitive, insistent and nit-picky. That's not to say a consumer is abusing their privledges. What I'm trying to say is that they are just machines and sometimes it take quite a few tries to finally fix them right, to discover the true problem and that is often after the orignal customer's patience has expired.
So you gotta' go on a case by case basis. A true lemon will have a branded title, it will say on the ownership certificate "LEMON" similar to "SALVAGE". A branded title makes most vehicles worth about half their intended value. A mediated consumer buy back may not show on the title, but it will be in the service history, it may be on Car Fax and it may be a material fact you'll need to diclose to a subsequent buyer, or not.
I personally am not afraid of lemons or buybacks, at the right price, but I'm in the car biz and I have more faith in the cars and the mechanics than the customers. As I mentioned, I feel there are almost no lemon cars, but many more lemon owners. For similar reasons I would only recommend a "SALVAGE" car to someone who works at a body shop.
