If he didn't there is nothing to do....go to court and bring pictures of the car and the glass.
I got pulled over for tints in MA after I had purchased an RDX with privacy glass on the rear. The fronts were tinted too when I bought the car. The first time driving to MA for the State Inspection (I live in a neighboring state but have MA tags) I got pulled over by a trooper and he used the photometer (or whatever that thing is called) and deemed that the fronts were over the limit, which made sense, but also that the rears were....now, that's a DOT approved glass that comes directly from the factory......I had to go to court and show that the car had been inspected and that the factory tints were fine (I had the fronts removed)....the cop didn't show up to court, so I didn't challenge his knowledge or lack thereof regarding window tinting...the case was dismissed.
I wasted a day for something that should not have gone that far anyways.....
I don't know how the cop can just "say" it's too dark...
