I googled california:

They base it on registration, not mileage. If it's never been registered (in any state), it's considered new. Conversely, if it's been bought/registered but has 11 miles on it, it's used. Looks like alot of states do it this way...the 'new' word has legal ramifications for lemon law cases, so they seem to leave out a number.
Aside to Bart: I bought two used cars in PA this year and they didn't charge me any tire fee...is that just for PA residents? (cars went to CT)
