I don't want to argue, but intented or not, people should be accounted for their action.
People kill others without intent still are guilty of manslater. Or do you think they should walk since they didn't intended to kill? yeah this example is like your example: overly excessively hypothetical.
If really was an accident and no harm done, I don't advise to follow up to this extent, but when they pointed fireworks to a car, they timed when to light it up, and run away after the hit, they fully knew it was a wrong thing. Also sounds like the kids also didn't tell the police the whole story. "police said according to my account and the kids', it seems to be a case of wrong place/wrong time" If kids told police that they were pointing at the car, police will definitely file a report instead of try to excuse himself from the scene asap so he can go get some donuts.
The kids didn't run up to his car to see if he was alright, saying "I'm sorry, are you ok? Do you need a medical assitance?" They didn't care if he crashed his car in the ditch and dieing blind. And parents came out the house appologizing. Which means they knew what the kids were doing. Otherwise, they would answered the door asap and called the kids to the door asking what they were doing.
And your point taken (I think). I don't care if it's illegal or not. BB gun, potato gun, arrow gun, snowball etc are all legal, but they cause harm if not used correctly. (have you ever thrown a snowball at an icecle to drop it? what if someone was under that?) Heck, even our Saabs can be used as a deadly weapon if not used right.
I would sue them if they used one of these against me with an intent to harm.
