Talked to my agent today. They are saying that since I'm moving to L.A. (from San Diego) to go to graduate school, my rate will increase to $2500/6mo.
Chaz, while I appreciate the suggestion, I think I'd be wasting my time to litigate. If there was a chance, I think Allstate would have done it to save paying out on the accident. The police report says "other motorists were able to either drive over or around the tire tread without losing control of their vehicles." It, and Allstate, say that my evasive maneuver to avoid hitting the tire violates the section of the vehicle code stating that I may not change lanes "until such movement can be made with reasonable safety."
So apparently the correct course of action (according to CHP and Allstate) was for me to hit the large industrial tire. I have been over this in my head a hundred times, and honestly searched for anything I could have done to be more reasonably prudent. I can categorically guarantee that had I hit that tire, I and likely others would be dead. The fact that other vehicles avoided the tire arises simply because I was the unlucky one in the wrong place at the wrong time.
Perfect driving record, one accident that I couldn't do anything to avoid, and this is what happens. Unfortunately, I may have to sell the Saab. Grad students can't pay $5k/year for car insurance.
