I agree the litigation has gone to far end of the spectrum - and yes a trained trooper should know better - but people do panic in some situations and can't think properly . Toyota's fine was based on trying to do a cover up and avoid a recall.
In the GM case though - it was reportedly back in 2001 that an engineer found the switch was poorly designed and far too easily switched off - a stronger spring was suggested - would have cost ~ $1.50 to make future cars safer but reportedly it was turned down as GM was focused on cost cutting. Then when crashes started to happen GM elected not the notify the owners directly about not hanging things from the key. They notified the dealers only about a new key if a customer complained about a problem with the car shutting off .
To many it appears GM put cost before customer safety.
