he would get a spouse visa that would allow him to live and work in the US, then apply for permanent residency in about 2 years. The marriage would get the usual scrutiny from the INS making sure it's a "real" marriage.
I'm not an immigration lawyer but have went through the immigration process 30 years ago from being a student (F-1) visa, to a skilled worker visa (H-1), petitioned for a Labor Certificate, then applied for permanent residency. The whole thing took years, not weeks or months.
What I don't understand is that if he is paying taxes, does he have a social security number ? Is he really on a tourist visa and not some other form of visa, such as an exchange visitor visa ??
The trouble is that other than marriage to a US citizen, many visa types mandate the person to leave the US first and then re-apply for a different type of visa in the home country. There is no guarantee that the visa application will be approved and that's the risk.
There is EB-5 Immigrant Investor visa, very popular these days with the newly rich from China. The amount of investment is $500,000 to $1 million depending on geographical location. My guess for NY City is $1 million.
He should get a consultation with a reputable immigration law firm to find out what options are available. The consultation would cost a few hundred dollars in NY City but it's worth it.
Political correctness aside, sometimes it seems easier for an illegal alien to become a US resident than going through the process legally.
Would he consider immigrating to Canada instead ? Canada has a more logical approach to immigration than the US. You get points with college degrees, work skills, work experience, age, etc.. and just count up the points and you're on your way to Canada. It also helps that he is from New Zealand, part of the British Commonwealth !
