Unfortunately too many people buy cars like they buy groceries - spur of the moment and without a lot of research. Buying a $4 box of cereal that looks good based on the picture on the box and finding out that it tastes like cardboard is one thing - buying a ~$30k car using the same amount of research is foolish.
Both the dealer and the buyer were wrong in this situation but it is ultimately the buyers responsibility to read between the lines, ask a lot of questions, follow up with even more questions, and do their own research. I guess I'm overly skeptic when I hear a salesperson talk while others are overly trusting.
My current Passat is a buy back (lemon/branded title). I bought the car fully aware of it's problems and only after I did some serious research about the car. I tracked down the dealership that did the work and talked extensively to them about the car and the latest work done (headlight issue). In the case of my car, the DRL failed (common problem on the B.5. Passats) more than three times and the dealer could not fix it. The car was bought back and taken to another dealer who ultimately fixed it. I ultimately decided I would get the car. Buybacks are funny - some (many) are legitimate cases where no amount of work will fix the car, in fact many times the constant repairs cause more issues, while other cars are a result of a customer simply wanting out of the car and take it back in time and time again only to claim "lemom law", and then other times it's a result of an incompetent service tech.
To me, it's a case-by-case basis but the key is, as you mention, do your research and read between the lines.
