The problem with overfilling is the crankshaft "splashing" the oil, frothing it. I have to think that there is a margin of error with the top fill mark.
I don't know exactly how the crankshaft is positioned in the pan, but what if the car is on a slope, seems potential oil level higher (in part of the pan).
If still on the plastic tab (disclaimer, I don't have the 9-3 dipstick in front of me), I probably wouldn't worry about trying to drain some off.
Now if you plan on a weekend of autocrossing or some other extreme "g's", then...
