I guess it would depend on what type of performance filter.
An "open air" filter where the OEM filter canister is completely removed and replaced by a visible foam cone could raise some eye brows and possibly result in voiding of your warranty - depending on what goes wrong with your car and how tough the Service Manager is regarding these things.
A lower restriction filter which resides in the OEM filter canister would never get noticed.
One word of advice though. All performance air filters rely on a film of oil applied to the filter media to collect the dirt. Excess oil gets carried away and can be deposited on the sensing element in the Mass Air Flow device , possibly causing it to fail. It is unreasonably expensive.
A new option just entered the market and I ordered mine tonight. SAAB now makes a less restrictive snorkel inlet to the filter cannister. It is inexpensive and appears to be a simple bolt on. I will be able to report back on perceived performance difference in a week or so after I install mine as part of the filter element replacement associated with my 150,000 mile service.
