I had one of these replace under the five year factory warranty because it was broken in the manner you describe.
You didn't say what year it was, but if it is new enough it should be a no-questions-asked replacement because it is a safety concern.
The driver's belt buckle is now sticking when I press the button to remove the latch, but unfortunately it is no longer under warranty. The part is about 85CDN, and an hour labour, so it will happen in the New Year.
