The filter is where it is on the 9-5 because it is the best place for it. It doesn't need to be on top of anything, and it is easy to change without disturbing the rest of the car.
Contrast that with my 1990 Volvo 740 turbo, where one has to disconnect the mass air sensor, the intercooler pipes, and push a couple things out of the way, and then wrestle the "right on top" cover off the air filter.
Or a Classic 900 or 99 with the 8v motor and CIS, where the filter is below the airflow sensor, which is connected to the motor by four 25 year old, brittle, plastic, all-but-unobtainable fuel lines.
If you want to complain about a filter on the 9-5, ever change the cabin filter????
