The engine will cut out the second you step on the brake without the key in the ignition. I believe the car will use gas regardless with light load or no loads since the engine is cold. Cold engine has tendency to use more gas because it's running richer than normal operating temperature. You can set for the engine to ilde, 5, 10 or 15 mins interval.
Back in the days with the older Saab 900's, you can't idle the car unintended for more than 2-3 mins, otherwise, the battery will be drained because of the charging system.
So, yes, it illegal to have your car idle unintended with the key in the ignition. In this case, the key is not in the ignition, so it can't be driven by thieves.
