If you look at a new axle nut, you will see that the part that protrudes past the hex is pinched in three places. When you torque the nut down, the added friction from the pinched threads acts as a locking element, preventing the nut from backing off.
A used nut will not exert anywhere near the needed force to fully prevent the nut from backing off.
